Do I Need to Tell the Home Office We Have Separated?

If your UK visa is based on your marriage or partnership, you must usually tell the Home Office when you separate from your husband. You do not have to wait until your divorce is final. What happens next depends on your current immigration status, whether the relationship has ended, and whether you have another basis to remain in the UK.

When must I report the separation?

The reporting requirement commonly applies if you have limited permission in the UK as a spouse or partner on a family visa, or as a dependant on your partner’s visa. It can also apply in some EU Settlement Scheme cases where your status is based on the relationship.

The same principle applies if your husband’s immigration permission depends on his relationship with you. If you already have indefinite leave to remain or British citizenship, separation does not normally end that status. Check the conditions of the permission you actually hold.

How do I tell the Home Office?

Use the GOV.UK separation and divorce reporting service. The official guidance also explains how to notify the Home Office by post and what details to include about both partners and any children in the UK.

Keep a copy of the information you submit. If you and your husband later reconcile after reporting the separation, update the Home Office.

Will my spouse visa be cancelled immediately?

Reporting the separation does not itself make your visa disappear that day. The Home Office may review permission granted on the basis of the relationship and decide whether to cancel it. The sponsor cannot personally cancel the other person’s visa.

Can I stay in the UK after separating?

You may have another immigration route, depending on your circumstances. Possibilities can include an application as the parent of an eligible child, a work route, a private-life application or another category for which you qualify. Each route has its own requirements; having held a spouse visa does not automatically qualify you for another one.

If the relationship permanently broke down because of domestic abuse, a separate route to settlement may be available to eligible applicants. Abuse is not limited to physical violence. Seek confidential, independent advice about your immigration position and safety.

What if we have children together?

Tell your adviser about any children in the UK, their nationality and immigration status, where they live, and each parent’s involvement in their care. These facts may be relevant to an application based on a parental relationship. They should also be accurately included when reporting the relationship breakdown to the Home Office.

What if my husband tells the Home Office first?

Either partner can report that the relationship has ended. His report does not, by itself, determine whether you qualify to stay on another basis. Make sure UKVI has your current contact details and obtain advice promptly if you receive a notice concerning your immigration permission.
