It is something that we can take for granted when we are talking to our clients, in that we just assume they understand the terms that we use. But what is Indefinite leave to remain? also, knowns as(ILR) this is a way in which your Thai wife can effectively settle in the UK leia o artigo. ILR grants the applicant almost the same rights as a UK citizen in that they will be allowed to live and work in the UK without any restrictions. You can apply for this after you have completed the 5-year route also known as further leave to remain.
Your Thai wife would be able to apply for ILR if she has been living in the UK on a UK Spouse Visa for a minimum of 5 continuous years. If you have any dependent children who have stayed with you for the same length of time, they too will be able to apply to ILR at the same time. Indeed, this is something that is very common and a scenario that we deal with on a frequent basis.
Check if you’re eligible for settlement (also called ‘indefinite leave to remain’) in the UK.
The standard forms that your Thai lady would require when she applies for Indefinite Leave to Remain would be Set (M). This set of form is to be completed by anyone who is the legal spouse of anyone who has already settled in the UK or is, of course, a British citizen. There is another set that is referred to as Set (O) and these should be used by all other people who are applying for ILR. This would include entrepreneurs, students or those working in the UK and have a valid UK work permit.
You should always allow yourself plenty of time when you are applying for ILR as processing can take up to six months although this does vary. After the applicant has had ILR status for 12 months, they can then apply to convert ILR status to British citizenship. Most commonly, this process is referred to as “naturalization”.
