Sham Marriages and UK Visas: Risks and Immigration Consequences
Marriage does not automatically give someone the right to enter or remain in the UK. A marriage arranged to obtain an immigration advantage without a genuine relationship can lead to investigation and serious immigration consequences.
For genuine couples, the important distinction is between marrying because you want to build a life together and using a marriage to disguise a relationship that does not genuinely exist. Having different nationalities, or needing a visa to live together, does not by itself make a marriage a sham.
Concerned about your relationship evidence?
If you are a genuine couple facing questions from UKVI, tell us about your circumstances and any correspondence you have received. We can explain how we can help with your application or direct you to appropriate specialist support.

In immigration terms, a sham marriage involves using a marriage to gain an immigration advantage where the relationship is not genuine. Similar concerns can arise with civil partnerships.
A genuine couple may understandably want to marry and apply for permission to live together. The immigration benefit of marriage does not, on its own, establish that their relationship is false.
An arranged marriage is also not automatically a sham marriage. The circumstances and genuine nature of the relationship must be considered.
Does a marriage certificate guarantee a UK visa?
No. A marriage certificate establishes that a marriage took place. It does not, by itself, prove that the couple meets the immigration requirements.
For a spouse or partner application, UKVI considers the relationship alongside the other requirements of the relevant route. A legally valid marriage can still result in a visa refusal if the application does not meet those requirements.
Couples should avoid anyone who promises that a wedding alone will secure a UK visa, prevent immigration action or guarantee settlement.
Can the Home Office investigate a proposed marriage?
Yes. Under the UK marriage referral and investigation scheme, certain proposed marriages and civil partnerships are referred to the Home Office.
Where the conditions for an investigation are met, the notice period can be extended from 28 days to 70 days. A referral or investigation does not itself establish that a relationship is a sham.
If you receive an investigation notice, read the instructions carefully, respond truthfully and obtain advice promptly. Completing the marriage notice process does not guarantee a later visa application will succeed.
What happens if a marriage is found to be a sham?
Depending on the circumstances, involvement in a sham marriage can lead to:
- Refusal of an immigration application.
- Cancellation or curtailment of existing immigration permission.
- Revocation of Indefinite Leave to Remain obtained through deception.
- Removal action where the person no longer has permission to remain, subject to the applicable legal process.
These outcomes are not identical in every case. The Home Office must assess the evidence, the individual’s involvement and the relevant legal provisions.
Helping someone arrange or attempt a sham marriage can also have consequences. The risks extend beyond the person seeking a visa.
False documents and dishonest visa applications
Do not submit invented relationship histories, fabricated messages, false address evidence or other misleading documents. An application must accurately describe the couple’s circumstances.
A finding of deception can affect future applications and may trigger a ten-year mandatory refusal period where the relevant rules apply. That period does not apply to every immigration route in the same way.
If inaccurate information has already been submitted, obtain advice before making another application or sending further explanations.
What if one partner was deceived?
The Home Office guidance recognises that one party may have been deceived about the relationship’s true purpose, or forced into the marriage. It may be inappropriate to take the same action against both parties.
If this applies to you, explain your own circumstances and seek independent advice. Keep relevant correspondence and documents. An allegation against the relationship should not be treated as proof that both partners knowingly participated.
How should genuine couples approach their application?
Prepare an honest account of your relationship and evidence that reflects your actual lives. Depending on the application, relevant material may include:
- A clear relationship timeline.
- Evidence of visits and time spent together.
- Relevant communication during periods apart.
- Marriage or civil partnership documents.
- Shared-address evidence where applicable.
- A clear explanation of your plans to live together.
Every relationship is different. Explain unusual circumstances accurately rather than trying to make your history resemble somebody else’s application.
Professional advice can help organise the evidence and identify gaps. It cannot turn a false relationship into a genuine one or guarantee a favourable decision.
What if UKVI wrongly suspects a sham marriage?
Take the allegation seriously. Read the notice or refusal letter, identify the concerns raised and obtain advice about your response and any deadline.
A suspicion, a finding that relationship evidence is insufficient and a formal sham marriage finding are different issues. The appropriate response depends on what UKVI has actually decided.
Any right of appeal, administrative review or other challenge depends on the decision and application route. Do not assume that submitting another application is the best next step.
