If you are married to a Thai citizen, you may be able to live in Thailand on a family-based Non-Immigrant O visa or an extension of stay based on marriage. But does that mean you can take a job or run a business? The short answer is that marriage alone does not give you permission to work.
The key distinction: Your visa or extension concerns your permission to stay in Thailand. Permission to work is a separate requirement. Arrange the appropriate work authorisation before starting a job.
Can you work on a Thai marriage visa?
Being married to a Thai citizen does not automatically authorise employment. A person staying in Thailand on the basis of marriage may be able to apply for a work permit, subject to their circumstances, the proposed role and the relevant authorities’ requirements. Check the route with your prospective employer and the Department of Employment before you start work.
Do not assume that your marriage certificate, Non-Immigrant O visa or marriage-based extension is itself a work permit. Likewise, do not assume you must change to a Non-Immigrant B visa in every case: the appropriate process depends on your immigration status and proposed employment.
What is a marriage-based stay?
A foreign spouse of a Thai citizen can apply for a Non-Immigrant O visa through the appropriate Thai embassy or consulate. An initial visa and a later extension of stay are different steps; an initial visa does not automatically grant a full year in Thailand. An extension must be applied for and approved under the applicable immigration rules.

What should you check before accepting work?
- Your present status: Confirm the visa or extension you hold and when your permission to stay expires.
- The proposed work: Give your employer a clear description of the role and where you will work.
- Work authorisation: Ask the employer to confirm the applicable work permit process and required documents with the Department of Employment.
- Immigration arrangements: Check whether taking the role affects your current basis for staying in Thailand or any future extension.
Wait until the required permission has been granted before beginning work. If your role, employer or circumstances change, check whether your authorisation needs updating.
Does getting married guarantee a one-year stay?
No. Marriage provides a possible basis for applying, but it does not automatically issue a visa, grant a one-year extension or approve a work permit. The decision depends on your application and the current requirements of the office handling it.
